Mrs. Akosua Serwaah Fosuh, the widow of the late Ghanaian highlife legend Charles Kwadwo Fosuh, popularly known as Daddy Lumba, has filed a defamation suit against social media content creator Miss Lydia Benson, popularly known as Morda.
The suit, filed at the High Court, Kumasi, Ashanti Region, under Suit No. GJ4/12/2026, was issued on 13th August, 2026 and filed on 13th August, 2026 at the Land/Human Rights Court.
Mrs. Fosuh, who resides in Bornheim, Germany, is suing per her lawful attorney, Mr. Osei Frank Nkrumah of Stadium Road, Kumasi.
According to the Writ of Summons and Statement of Claim sighted by this portal, the Plaintiff says she lawfully contracted a civil marriage with the late Daddy Lumba in Bornheim, Germany, on 23rd December, 2004, with an official German marriage certificate, and that the marriage was never dissolved and remained subsisting until his death on 26th July, 2025. She says three children were born out of the marriage and that she was publicly known and recognized as his wife.
She accuses the Defendant, a TikToker based at Anwomaso High Tension, Phanerosis, Kumasi, of conducting live broadcasts on TikTok on or about 3rd, 4th, 6th and 9th August, 2026, in which she made several false and defamatory statements in Twi concerning her.
Particulars of the allegations as contained in the writ include claims that:
a. The Plaintiff has no marriage certificate;
b. The Plaintiff was divorced by the late Daddy Lumba;
c. The Plaintiff was not and/or is not the lawful wife or widow of the late Charles Kwadwo Fosuh;
d. The Plaintiff is or was a prostitute and/or sexually immoral;
e. The Plaintiff has dishonestly misrepresented her marital status.
The Plaintiff is also complaining about statements where the Defendant allegedly said: “Maame no ɔne Lumba gyae yɛ, ɛyɛ papers na ɔmo antwitwam” – to wit, the woman and Lumba had divorced except for paperwork; “Woboa, ɔnyɛ yere, Ghana court bebiara ɔbɛkɔ no ɔbɛ loss” – liar, she is not a wife, every court she goes to in Ghana she will lose; and _”Mmoaa, ma mo dare me, meyɛ ashawonii te sɛ maame no a mo som no no” – among others.
The Plaintiff says the family issued a public press release on 5th August, 2026, disputing the claims and asking the Defendant to cease and retract, but the Defendant refused and continued with further publications on 6th and 9th August.
Reliefs:
Mrs. Fosuh is therefore seeking from the court:
1. A declaration that the words published on 3rd, 4th, 6th and 9th August are false and defamatory;
2. A perpetual injunction restraining the Defendant, her agents and assigns from publishing the defamatory allegations;
3. An order directing the Defendant to retract and publish an unqualified public apology with equal prominence on her TikTok and other platforms;
4. General damages for defamation, including aggravated damages, assessed at GH¢1,000,000.00;
5. Costs including legal costs.
The writ, filed by Lawyer Kwaku Obiri Anim Addo of Kwame A. Boafo & Associates, Nyame Adom Chambers, Adum, Kumasi, orders the Defendant to enter appearance within eight (😎 days after service, failing which judgment may be given in her absence.
