#Ghana Bar Association Calls for Reinstatement of Suspended Chief Justice

The Ghana Bar Association (GBA) has urged President John Mahama to revoke the suspension of Chief Justice Gertrude Torkornoo, citing the decision as unconstitutional. The call comes after a vote by GBA members, where 47 voted in favor of the resolution, 5 against, and several abstained.
Key Points of the GBA’s Argument:
– Unconstitutional Suspension: The GBA believes President Mahama overstepped his powers by suspending the Chief Justice without a proper legal basis.
– Lack of Transparency: The association demands that President Mahama release the full decision establishing a prima facie case against Chief Justice Torkornoo, ensuring transparency and fairness in the process.
– Judicial Independence: The suspension has sparked debate about judicial independence, with the opposition accusing President Mahama of attempting to “pack the courts” with sympathetic judges.
Chief Justice Torkornoo was suspended on April 22, 2025, following three separate petitions alleging misconduct, including tampering with court records and misuse of public funds. A five-member committee, led by Supreme Court Justice Gabriel Pwamang, has been established to investigate the allegations.
The suspension has drawn mixed reactions, with some supporting the president’s decision as a necessary step in the constitutional process, while others see it as an attack on the judiciary. The outcome of the investigation will determine the fate of Chief Justice Torkornoo.
